The EU Services Directive is one of the cornerstones for the realization of the EU internal market and is fundamental to economic and legal experts in governments, trade and industry, as well as to the general public. This book analyses in detail the different steps taken by each of 26 EU Member States (all but Greece) in the implementation process of the Services Directive. It provides not only detailed information about the changes in national law adopted by the Member States, but also facilitates a comparison of the different implementation strategies. It gives an insight in the heterogeneity or homogeneity of implementation concepts and shows how European legislation affects legislation that was originally nationally dominated, such as the law of national administration. This book is valuable reading for academics interested in European and administrative law and the transposition of European directives into domestic law, as well as for practitioners and civil servants in ministries, chambers of commerce, local governments and other comparable institutions having to implement the Directive. Ulrich Stelkens and Wolfgang Weiß are both University Professors of Law at the German University of Administrative Sciences Speyer and Ordinary Members of the German Research Institute for Public Administration Speyer, Michael Mirschberger (Ass. Jur.) is research assistant at both institutions.

This book analyses many aspects of the present EU regulatory framework for public contracts, especially public procurement, taking the ongoing reform process into account. First, several chapters discuss the regime of the Public Sector Procurement Directive 2004/18/EC governing the procurement activities of the EU Member States, the coverage of the Directive, qualification and technical specifications, procurement procedures, and award criteria. A specific chapter describes the EU principles applicable to contracts not covered or partially covered by the Directive, which have been the subject of relevant developments in the case law of the European Court of Justice. Another chapter covers sustainable procurement. Second, three chapters are devoted to special procurement regimes, namely public private partnerships, defence and utilities. Third, the review and remedies regime for public procurement is covered in two chapter. Fourth, one chapters goes beyond public procurement and looks at the effect of EU law on the contract management of public contracts, after their conclusion. Fifth, three chapters go beyond the regulation of the Member States and look at the EU law regime applicable to contracts of the EU institutions. Sixth and finally, a concluding chapter provides a critique of the EU legal framework by an author from outside the EU.

This book presents an analysis of the concept of the administrative act and its classification as ‘foreign’, and studies the administrative procedure for adopting administrative acts in a range of countries in and outside Europe. While focusing on the recognition and execution of foreign administrative acts, the book examines the validity, efficacy and enforceability of foreign administrative acts at national level. The book starts with a general analysis of the issue, offering general conclusions about the experiences in different countries. It then analyses the aforementioned themes from the perspective of the domestic law of different European nations and a number of international organisations (European Union, MERCOSUR, and Andean Community). In addition, the book studies the role of the European Union in the progress towards the recognition and execution of foreign administrative acts, where the principle of mutual recognition plays a vital part. Finally, the book analyses the international conventions on the recognition and execution of administrative acts and on the legalisation of public documents.

A vivid, often surprising account of South Asia today by the author of An End to Suffering In his new book, Pankaj Mishra brings literary authority and political insight to bear on travels that are at once epic and personal. Traveling in the changing cultures of South Asia, Mishra sees the pressures—the temptations—of Western-style modernity and prosperity, and teases out the paradoxes of globalization. A visit to Allahabad, birthplace of Jawaharlal Nehru, occasions a brief history of the tumultuous post-independence politics Nehru set in motion. In Kashmir, just after the brutal killing of thirtyfive Sikhs, Mishra sees Muslim guerrillas playing with Sikh village children while the media ponder a (largely irrelevant) visit by President Clinton. And in Tibet Mishra exquisitely parses the situation whereby the Chinese government—officially atheist and strongly opposed to a free Tibet—has discovered that Tibetan Buddhism can "be packaged and sold to tourists." Temptations of the West is a book concerned with history still in the making—essential reading about a conflicted and rapidly changing region.
